Overview

The following document, termed as the Affiniti Referral Agreement (the "Referral Terms"), outlines the regulations governing the Affiniti Referral Program outlined within your Account dashboard (the "Referral Page"). It delineates the terms under which you may qualify for, accrue, utilize, or potentially forfeit incentives ("Bonuses"). The terms "Company" or "You" refer to the legal entity and its authorized representative with an active Account in good standing with Affiniti Finance, Inc. ("Affiniti"). These terms become effective upon the establishment of your Account with Affiniti Finance, Inc. Any capitalized terms utilized herein but not defined are attributed the meanings ascribed to them in other agreements existing between You and Affiniti ("Affiniti Agreements"). Your participation in the Affiniti Referral Program is contingent upon your acceptance of all stipulations outlined in these Referral Terms.

1. Referral Bonus Terms

  1. You may earn Bonuses up to the Bonus Limit for each third party you refer under these Referral Terms ("Referred Party") who:
    1. Opens a new approved Account with Affiniti and;
    2. Meets the Eligible Purchases (as defined in the Cardholder Agreement) criteria along with all the Affiniti Referral Program qualifications found on the latest Referral Page.
  2. All Bonuses will be credited in Reward Points as defined in the Cardholder Agreement. All terms and conditions governing Reward Points will be applicable.
  3. Affiniti reserves the right to reject anyone that is referred or close their Account subject to the Affiniti Agreements.

2. Referrer Eligibility Criteria

  1. Upon the establishment of your Account, you become entitled to receive Bonuses. To sustain eligibility for Bonuses, it is imperative that your Account remains open and in favorable standing. In the event of any breach of other Affiniti Agreements, failure to uphold the favorable status of your Account, involvement in fraudulent actions, misuse of Bonuses, or violation of these Referral Terms, we reserve the right to revoke your entitlement to receive Bonuses.
  2. You are not eligible to receive Bonuses if:
    1. You refer another company owned or controlled by you;
    2. We have reason to believe you have completed duplicate applications for the purposes of obtaining additional Bonuses, a sum beyond any Bonus Limits, or;
    3. We suspect that you are attempting to circumvent any rules of the Affiniti Referral Program.
  3. Whether you receive the Bonus for referring a third party under these Referral Terms will depend on the Eligible Purchases of the Referred Party. Additionally, the Referred Party must be approved for an Account and be in Good Standing for the first 90 days of their Account being opened for you to qualify for the Bonus. Any determination by us of satisfaction of the eligibility criteria will be subject to verification and at our sole discretion.

3. Taxes

  1. According to relevant laws, we might need to provide you and the IRS with a Form 1099-MISC, Form 1042-S, or another relevant form for the year in which you earned these Bonuses. You are accountable for any tax obligations related to participating in this offer. If you have inquiries regarding the potential tax implications, please seek advice from your tax advisor.

4. Modifications and Releases

  1. This offer is subject to change and may be changed or canceled by Affiniti at any time without notice. You agree and acknowledge that Bonus qualifications, any Bonus Limits, Referral Terms, and the Affiniti Referral Program are subject to change at any time — which we will modify by posting an updated version to our legal page or by providing notice to you. The latest information can be found on the Referral Page.
  2. We may also condition, restrict, or limit the availability of Bonuses in our sole discretion. Any delay by us in enforcing our rights under these Referral Terms or the Terms of Use does not constitute forfeiture of such rights.
  3. The Affiniti Referral Program can be ended by us at any time and at our sole discretion. Also, if we or you close your Account, these Referral Terms will end immediately.
  4. You release us from any liability arising from your involvement in the Affiniti Referral Program, as well as from any third-party claims arising from, related to, or incurred by or against you in connection with the Affiniti Referral Program or these Referral Terms.

5. Authorizations

  1. By referring a third party under these Referral Terms, you consent to Affiniti sharing your full name and your business’ name with the Referred Party for the purpose of facilitating the Affiniti Referral Program.
  2. You retain the right to withdraw your consent for sharing your information at any time. To do so, you must send a written request to support@affiniti.finance which we will process within a reasonable timeframe.
  3. Should you choose to withdraw your consent, you acknowledge that any pending referral Bonus will be forfeited and we may delete records of your referrals from our systems to accommodate your request.
